Binding commitment
You may not have a cooling-off period after a traditional auction bid.

Before the bid.
Before the contract.
A successful traditional auction bid normally creates a binding contract immediately. The ordinary “subject to contract” period has effectively happened before the auction, through the legal pack.
A solicitor can review that pack, explain the special conditions and highlight matters affecting ownership, use, funding and resale before you decide whether to bid.
Discuss your auction matter ↗You may not have a cooling-off period after a traditional auction bid.
Special conditions may impose additional payments, shortened deadlines or unusual responsibilities.
Rights, covenants, access and planning information may affect what you can do with the property.
Legal or physical issues may make the lot unacceptable to a mortgage lender.
Problems found after a binding bid do not usually give you a right to withdraw.
Pre-auction advice cannot remove all uncertainty, but it can reveal the terms and legal risks you are being asked to accept. That makes it a practical part of deciding whether the lot is right for you.

Discuss the headline circumstances.
Legal advice is one part of a sound pre-bid investigation.
Download the full pack early and watch for addenda.
Combine the solicitor’s review with an appropriate survey and finance advice.
Bid only after considering the legal, physical and financial position.
Express Conveyancing manages a panel of solicitors and licensed conveyancers for residential auction matters in England and Wales.
Every transaction is considered individually. If the matter can be accepted, we will allocate a suitable available legal provider, who will then advise you and deal with the agreed work under its own terms of engagement.
Not generally, but obtaining advice is strongly recommended because a successful bid may bind you immediately to the contract and its special conditions.
As soon as the pack is available. Earlier instructions allow more time to consider the papers, ask questions and react to missing information.
Yes, where appropriate. The legal pack does not tell you the physical condition or value of the property, and a solicitor does not inspect it.
The catalogue is marketing material and is usually subject to qualifications. The legal pack, auction conditions, addenda and your own investigations are critical.
Please telephone us first wherever possible. We will discuss the headline circumstances, funding and timescale before confirming whether a suitable panel legal provider may be available.
